A patent for an invention is the grant of a property right to the inventor, issued by the Patent and Trademark Office (or corresponding office of any other government) which prohibits any other person or entity within its jurisdiction from making, using, offering for sale, selling or importing the patented product without payment of royalties to the inventor(s) named on the patent, or to the owner(s) if assigned. |
| The Patent Act provides intellectual property rights protection for an invention that is new or involves an inventive step, and is suited to industrial application. Today, the patent protection period gives inventors the opportunity to recoup their (Research and Development) R & D investments in new products either by direct manufacture and sale or by licensing. |
| In general, the patent, which can be registered by an individual or a corporation, provides absolute protection for 20 years, after which the innovation can be used by anyone. Therefore, Thai government has an initiative to develop innovations whose patents have already expired for industrial application so that Thai society could benefit from them. |
